Terms of Use

These Terms of Use are the agreement between you and Plant Powered Marketing LLC, doing business as Spray Foam Genius Marketing, which owns and operates Foam Genius Network ("we," "us"). By creating an account or using the site, you agree to them. If you do not agree, do not use the site. Version 2026-09-26.

What Foam Genius Network is

Foam Genius Network is an online platform that helps individuals and companies in the insulation industry discover and connect with one another.

Foam Genius Network and Spray Foam Genius Marketing are not employers, staffing agencies, recruiters, labor contractors, employment agencies, or parties to any employment, independent contractor, subcontractor, or other working relationship arranged through the platform.

Users are solely responsible for evaluating one another and determining the terms, legality, classification, compensation, insurance requirements, licensing requirements, taxes, safety requirements, and other conditions of any working relationship.

Foam Genius Network does not hire, employ, supervise, direct, control, pay, insure, or guarantee any worker or company listed on the platform.

Your account

• You must be at least 18 years old.
• One account per person unless we authorize otherwise.
• The information you provide must be accurate. You are responsible for keeping your profile accurate and current, including your availability.
• You are responsible for protecting your password and for activity under your account.
• Companies must represent legitimate businesses, and the person who creates a company account must have authority to represent that company.

We may request additional information when reasonably necessary to verify an account, investigate suspected abuse, or protect users of the platform.

We reserve the right to restrict, suspend, or terminate accounts that violate these Terms, create safety concerns, misuse the platform, or provide materially false or misleading information.

Text messages

If you provide a mobile number, you agree to receive text messages from Foam Genius Network, including verification codes. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

Jobs and working relationships

Companies and individuals posting employment, contract, subcontract, temporary, relocation, or project opportunities are solely responsible for ensuring that their listings and working relationships comply with applicable federal, state, provincial, and local laws. This includes, where applicable:

• Wage and hour requirements
• Worker classification
• Employment laws
• Independent contractor laws
• Licensing requirements
• Insurance requirements
• Immigration and work authorization requirements
• Workplace safety requirements
• Tax obligations
• Anti-discrimination laws
• Hiring and termination laws

Foam Genius Network does not determine whether a worker should be classified as an employee, independent contractor, subcontractor, or any other classification.

Users are responsible for obtaining their own legal, tax, insurance, employment, and professional advice regarding working relationships created through the platform.

Job and project posts must be for real openings and must show real pay. No fees to apply, no multi-level marketing, no bait-and-switch.

Verification and credentials

Foam Genius Network may allow users to submit licenses, certifications, insurance information, work history, experience, photos, references, identification, or other credentials.

Unless expressly stated otherwise, Foam Genius Network does not independently verify the accuracy, authenticity, completeness, validity, or current status of information submitted by users. Certifications, insurance, and experience are shown as Self-Reported.

A verification badge or similar designation only confirms the specific verification described on our Trust and Verification page. A verification badge does not constitute:

• An endorsement
• A recommendation
• A certification of competency
• A criminal background check
• A safety guarantee
• A guarantee of identity
• A guarantee of qualifications
• A guarantee of licensing
• A guarantee of insurance
• A guarantee of experience
• A guarantee of conduct
• A guarantee of suitability for employment or contracting

Users are responsible for performing their own due diligence before hiring, employing, contracting with, working for, paying, or otherwise entering into an agreement with another user.

Assumption of risk

Interactions between users may involve construction sites, insulation materials, spray foam chemicals, equipment, vehicles, ladders, machinery, travel, temporary work, and other potentially hazardous activities.

Users voluntarily assume the risks associated with communicating with, hiring, employing, contracting with, meeting, traveling with, or working for other users of Foam Genius Network.

Foam Genius Network does not control job sites, working conditions, equipment, training, safety procedures, transportation, supervision, or the conduct of users.

Users are responsible for determining whether another user, company, job opportunity, worksite, or working relationship is appropriate and safe for them.

Reviews and ratings

Reviews and ratings represent the opinions and experiences of individual users and do not represent the opinions of Foam Genius Network or Spray Foam Genius Marketing. We do not endorse or guarantee the accuracy of reviews.

Users may only review people or companies with whom they have had a legitimate interaction or working relationship. Reviews may not contain:

• Knowingly false information
• Threats
• Harassment
• Discriminatory or hateful content
• Private personal information
• Phone numbers or personal contact information
• Extortion or attempted extortion
• Reviews submitted in exchange for compensation or another benefit
• Reviews posted by a user about themselves or their own company

We reserve the right to investigate, restrict, hide, or remove reviews that violate these Terms, applicable law, or platform policies. We do not change what a review says. We are not obligated to resolve disputes between users regarding reviews.

Your content

You keep ownership of the content you submit to Foam Genius Network.

By submitting content, you grant Foam Genius Network and Spray Foam Genius Marketing a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, modify as technically necessary, and use that content as reasonably necessary to operate, secure, maintain, promote, and improve Foam Genius Network. Content is shown according to your privacy settings.

You represent that you own or have the necessary rights and permissions to submit your content and that it does not violate another person's intellectual property, privacy, publicity, contractual, or other legal rights. You remain responsible for content you submit. You can delete it at any time.

Our intellectual property

Foam Genius Network, its software, website design, databases, graphics, branding, logos, original text, features, and other proprietary materials are owned by Spray Foam Genius Marketing or its licensors.

You may not copy, reproduce, scrape, republish, reverse engineer, commercially exploit, or redistribute Foam Genius Network content, software, databases, or proprietary materials without authorization, except where permitted by applicable law.

Copyright complaints

We respect intellectual property rights and expect users to do the same. If you believe content on Foam Genius Network infringes your copyright, send a notice to our designated copyright agent that includes:

• Your name, address, phone number, and email
• A description of the copyrighted work you believe was infringed
• The link or location of the content on our site
• A statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them
• Your physical or electronic signature

If your content was removed and you believe it was a mistake, you may send a counter-notice to the same agent. It must include your contact information, a description of the removed content and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any judicial district in which we may be found), and your signature.

We may remove content that is the subject of a notice and may terminate the accounts of users who repeatedly infringe.

Not allowed

• Fake profiles, fake companies, or impersonation
• Fraud, scams, or spam
• Scraping or automated data harvesting
• Selling user information, or collecting contact information for unrelated marketing
• Circumventing blocks, limits, or account suspensions
• Harassment, threats, discrimination, or hate speech
• Malicious software, attempts to compromise the platform, or unauthorized access
• Misrepresentation of certifications, insurance, employment history, or qualifications
• Posting fraudulent jobs or jobs for illegal activity
• Using the platform for purposes unrelated to legitimate employment, contracting, networking, or insulation-industry business activity

We can review, hide, or remove content and restrict, suspend, or close accounts that break these rules.

Price

Foam Genius Network is currently free for insulation professionals and employers while we're building the network. We may add paid memberships or paid features later. We will tell you before any pricing changes and before you are charged for anything. Nothing is charged without your agreement.

No guarantees

Foam Genius Network provides a platform for users to discover and communicate with one another. We do not guarantee:

• Employment, workers, or applicants
• Job availability
• Work quality, job completion, or worker or company performance
• Payment or compensation
• Accuracy of user information
• Availability of the platform
• Safety of a user or workplace
• Legality of a particular working relationship
• Results from using the platform

Users enter into relationships with other users at their own discretion and risk. The platform is provided as is and as available.

Disclaimer of warranties

FOAM GENIUS NETWORK IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FOAM GENIUS NETWORK, SPRAY FOAM GENIUS MARKETING, AND PLANT POWERED MARKETING LLC DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON IT IS ACCURATE.

Limitation of liability

To the fullest extent permitted by applicable law, Foam Genius Network, Spray Foam Genius Marketing, Plant Powered Marketing LLC, and their owners, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from or related to use of the platform or interactions between users.

This includes claims arising from employment relationships, contracting relationships, job-site incidents, personal injury, property damage, nonpayment, misconduct, inaccurate user information, disputes, reviews, communications, hiring decisions, or actions of other users.

Our total liability to you for all claims related to Foam Genius Network will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Foam Genius Network, Spray Foam Genius Marketing, Plant Powered Marketing LLC, and their owners, officers, employees, contractors, affiliates, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• Your use of the platform
• Content you submit
• Your interactions with other users
• Employment or contracting relationships
• Jobs or projects you post
• Your violation of these Terms
• Your violation of applicable law
• Your violation of another person's rights

Disputes between users

Foam Genius Network is not responsible for resolving disputes between users. This includes disputes involving:

• Hiring or firing
• Compensation or payment
• Job performance or work quality
• Property damage or injuries
• Employment classification or contracts
• Reviews
• Travel, housing, or equipment
• Job-site conditions

We may assist with reports or platform-related issues at our discretion, but doing so does not make us responsible for the underlying dispute.

Disputes with us

If you have a concern about Foam Genius Network, please contact us first. Most issues can be resolved quickly that way. If we can't resolve it within 30 days, either of us may bring a claim in the courts listed under "Governing law and venue." To the extent permitted by applicable law, claims must be brought individually, not as part of a class or representative action.

Ending your account

You can delete your account at any time in Settings.

We may restrict, suspend, or terminate accounts or access to the platform if we reasonably believe a user:

• Violated these Terms
• Violated applicable law
• Created a safety risk
• Engaged in fraud or abuse
• Misrepresented their identity or credentials
• Misused another user's information
• Attempted to compromise the platform

Where appropriate, action may be taken without prior notice.

Legal requests

We may preserve, access, or disclose information when reasonably necessary to comply with applicable law, legal process, court orders, regulatory requirements, or valid governmental requests, or to investigate fraud, abuse, security incidents, or threats to users or the platform.

Governing law and venue

Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Any court proceeding permitted under these Terms will be brought in the state or federal courts having jurisdiction in Clark County, Washington, unless applicable law requires otherwise.

If you live in Canada or another country outside the United States, nothing in these Terms limits any rights you have under mandatory local laws that cannot be waived by agreement.

General terms

• Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about Foam Genius Network.
• Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
• No waiver. If we don't enforce a part of these Terms, that doesn't mean we give up the right to enforce it later.
• Assignment. You may not transfer your account or these Terms to anyone else. We may transfer these Terms as part of a merger, sale, or reorganization.
• Survival. Sections that by their nature should continue after your account ends, including Your content, Our intellectual property, Disclaimer of warranties, Limitation of liability, Indemnification, Disputes with us, and Governing law and venue, will survive.
• Electronic communications. You agree that we can send you notices electronically, and that electronic notices satisfy any requirement that notices be in writing.

Changes

We may update these Terms. If a change is material, we will tell you by email or on the site before it takes effect. Using the site after that means you accept the updated Terms.
